Faster Military Investments: New Rules for Land Acquisition and Construction

The draft bill introduces special rules for the preparation and implementation of strategic and key investments for state defense and public security, including under the 'Eastern Shield' program. It regulates the acquisition of real estate for these investments, the establishment of protective zones for closed areas, and defines permissible noise levels.
Key points
A mechanism for expropriating real estate for strategic investments with compensation has been introduced. For releasing the property within 30 days, the compensation is increased by 5% of the property value, and for residential buildings, an additional PLN 10,000 is provided for moving costs.
The voivode may establish a protective zone for a closed area, where prohibitions and restrictions on land development or use will apply (e.g., regarding the construction of facilities, location of installations, or storage of materials).
Strategic and key investments will be implemented based on special permits, excluding certain regulations on spatial planning, protection of agricultural and forest land, and certain requirements of the Construction Law.
The act specifies in an annex the permissible noise levels for closed areas established by the Minister of National Defense or the minister responsible for state assets.
The regulations are intended to streamline the implementation of investments, including those included in the 'National Deterrence and Defense Program – Eastern Shield'.
