New regulations strengthen the rights of non-accused persons, especially witnesses, in criminal proceedings. They guarantee the right to a legal representative at every stage and mandatory recording of interrogations and hearings, aiming to increase transparency and prevent abuses. This ensures citizens greater certainty that their testimonies are reliably documented and their rights respected.
Key points
Right to a lawyer: As a witness or other non-accused person, you can have your legal representative (lawyer) present during any activity in criminal proceedings, such as an interrogation.
Mandatory recording of interrogations and hearings: Witness and expert interrogations will be recorded (audio and video) upon a participant's request or in specific situations. Court hearings will also be recorded, increasing their transparency.
You can record hearings: Any participant in a court hearing will be able to record its proceedings with their own equipment (audio or audio and video), but without the possibility of publishing these materials.
Greater protection against abuses: An official who prevents your legal representative from being present will be automatically excluded from the case. This aims to protect against pressure and unfair practices.
