Simplifications in Construction Law: Easier Building and Digital Documentation
New regulations aim to simplify and accelerate the construction process for citizens and businesses by expanding the list of investments that do not require a building permit or notification. They also introduce clear definitions of buildings and streamline the digitization of documentation, although deadlines for full electronic transition have been extended.
Key points
Easier construction of small public utility buildings (up to 200 m²) and home shelters (up to 35 m²) – only notification is required instead of a building permit.
Simplified rules for building home swimming pools, ponds, terraces, flagpoles, and small wind turbines – often without a permit or notification.
Farmers will find it easier to build rainwater harvesting tanks (up to 30 m³) and other agricultural facilities, supporting the "My Water" program.
The deadline for mandatory electronic construction logbooks and digital building logbooks has been extended to 2034.
A "yellow card" mechanism has been introduced for minor construction irregularities, giving investors a chance to rectify them without immediate administrative proceedings.
Key construction terms (e.g., residential building, shed) have been standardized by moving them from regulations to the act, aiming to eliminate interpretive ambiguities.
Changes have been made to the appointment of district building supervision inspectors, reducing the required number of candidates from three to two to facilitate staffing.
