New Rules for Autonomous Vehicle Testing on Public Roads

The act introduces new rules for testing automated and fully automated vehicles on public roads. Research companies will need to obtain a special permit, valid for up to 3 years and subject to a fee. The aim is to enhance road safety and support the development of modern transport technologies.

Definitions of automated and fully automated vehicles have been introduced, along with six levels of driving automation.
A National Coordinator for Research Work (Director of the Motor Transport Institute) has been appointed to issue and oversee testing permits.
Testing of automated vehicles below level 3 automation will not require a permit.
Permits for testing will be issued for a maximum of 3 years and will be subject to fees (from 20,000 PLN to 40,000 PLN for issuance, 5,000 PLN for changes).
Test organizers will be required to equip vehicles with electronic image and sound recorders, conduct simulated and physical tests off public roads, and have mandatory third-party liability insurance.
Financial penalties have been introduced for conducting tests without a permit (from 200,000 PLN to 450,000 PLN) or in violation of conditions (from 50,000 PLN to 200,000 PLN).
A portion of the permit fees (30%) will be transferred to the budgets of local government units where tests are conducted.
Entrepreneurs dealing with used vehicles can now use professional registration for test drives.
