Monument Protection: Notifications Replace Permits, Tree Removal and New Penalties
The deregulation bill introduces a notification system (with silent consent) for certain activities regarding monuments that previously required a permit, such as works in the surroundings of a monument. It adds a permit requirement for mining works and unifies tree removal procedures in historic areas (single decision). It sets financial penalties: up to PLN 500,000 for lack of permit and up to PLN 50,000 for lack of notification.

Conducting mining works at a registered monument was added to the list of activities requiring a permit from the provincial monument conservator.
The procedure for removing trees from historic parks and gardens was unified – the provincial monument conservator issues a single decision, also taking into account nature protection regulations.
Financial penalties were differentiated: actions without a permit are subject to a fine of PLN 500 to PLN 500,000, while actions without the required notification (or against an objection) are subject to PLN 500 to PLN 50,000.
The Construction Law was amended to allow obtaining a building permit based on a certificate of no objection from the conservator regarding a submitted notification.
