Tree removal on private property: a faster, more predictable process.
New rules will make it faster and easier for individuals to remove trees from their property for non-business reasons. The law sets a strict 60-day deadline for officials to object, preventing indefinite delays and increasing legal certainty for property owners.
Key points
Maximum 60-day wait for a decision: If the office doesn't object within 60 days of your notification, you can legally remove the tree. This ends situations where a lack of inspection could stall the process indefinitely.
More detailed notifications required: You will need to provide more information when reporting a tree removal, such as species, trunk circumference at two heights, purpose, and a map of the tree's location.
New penalties for unreported removal: The law introduces clear financial penalties for removing a tree without filing the required notification or before the objection deadlines have passed.
Safeguard against misuse: If construction related to a business activity starts on the property within 5 years of removing a tree, the owner will be charged a fee for its removal.
