Stricter Penalties for Dangerous Driving, Illegal Races, and Drunk Driving
New regulations introduce significantly harsher penalties for drivers who violate traffic laws, particularly for illegal races, reckless driving, driving under the influence of alcohol, and non-compliance with driving bans. The changes aim to increase road safety and protect citizens' lives and health, including lifelong driving bans for repeat offenders and mandatory vehicle forfeiture in certain situations.
Key points
Lifelong driving ban: Drivers who repeatedly violate a court-ordered driving ban may receive a lifelong ban from operating any motor vehicles.
Mandatory vehicle forfeiture: If a vehicle is driven with a blood alcohol content of at least 1.5 per mille, the court will be obliged to order the forfeiture of the vehicle, unless exceptional circumstances apply. Vehicle forfeiture may also be possible at lower alcohol concentrations (0.5-1.5 per mille) or in case of violating a driving ban.
Criminalization of illegal races: Organizing or participating in illegal motor vehicle races will be punishable by imprisonment from 3 months to 5 years.
Harsher penalties for reckless driving: Driving a vehicle in a manner that grossly violates safety rules, endangers others, and involves significant speeding, will be punishable by imprisonment from 3 months to 5 years.
Higher fines for offenses: Minimum and maximum fines for certain traffic offenses will increase, e.g., for intentional skidding (drift) – minimum 1500 PLN, and in case of endangering safety – minimum 2500 PLN.
Driving license suspension for drifting: Intentional skidding or loss of wheel contact with the road surface (drift) will result in a 3-month driving license suspension.
Obligation to report vehicle gatherings: Gatherings of more than 10 vehicles for display purposes will require prior notification to the municipal office. Failure to report or participation in an unreported gathering will be an offense.
Easier access to data for victims: Victims of traffic offenses will be able to obtain the data of the perpetrator fined by ticket upon request, facilitating the pursuit of compensation.
