Changes in Plant Protection: Digitalization, New Controls, and Safer Plant Protection Products

The draft act introduces significant changes for farmers, importers, and exporters. It digitizes many procedures related to plant varieties and seeds, making it easier to handle matters online. At the same time, it tightens the rules for the sale and use of plant protection products intended for fumigation, banning their online sale and obliging sellers to keep records of buyers to increase safety.
Key points
A ban on online sales of plant protection products intended for fumigation; sellers will be required to maintain a register of buyers and issue personalized invoices.
An electronic register of persons who have obtained certificates of training completion or authorization to purchase plant protection products will be created.
Businesses exporting plants will be able to obtain the status of a "trusted exporter," which will allow for reduced frequency of inspections.
Applications regarding the entry of varieties into the register and field inspection of seed material can be submitted via an ICT system.
The possibility of inspecting wooden packaging materials outside the border control post, e.g., at the destination, has been introduced upon the consent of the voivodeship inspector.
The amount of administrative fines for violations of regulations has been changed, introducing ranges from PLN 500 to PLN 10,000 instead of a fixed amount.
