Faster Crime Information Exchange Abroad: New Rules for Services
The draft law implements EU Directive 2023/977, streamlining information exchange between Polish authorized entities and law enforcement agencies of EU states and other countries. The new regulations introduce strict deadlines for data transfer and expand the powers of the Contact Point. The aim is to implement EU law and increase the efficiency of detecting and combating crime.
Key points
Faster response to requests: Strict deadlines for providing answers have been introduced, including 8 hours for urgent requests with direct data access.
Strengthened Contact Point: The contact point at the National Police Headquarters will operate 24/7 and gain access to new databases, including the Weapon Registration System and Operational Information System.
Data protection and verification: A requirement to verify personal data for accuracy, currency, and completeness before transfer has been introduced.
Exchange on own initiative: The contact point or authorized entities will be able to provide information without a request if it contributes to detecting perpetrators or preventing a crime.
Reporting to the EC: The Commander-in-Chief of the Police will annually submit statistics on information exchange to the European Commission.
