Verification of Family Benefits for Foreigners and Changes in Aid for Ukraine
The law introduces new conditions for receiving child benefits (800+) and other family benefits by foreigners, linking them to professional activity and the child's fulfillment of compulsory education. It also extends the legal stay and access to benefits for Ukrainian citizens until March 4, 2026, but limits the scope of free healthcare and introduces changes to collective accommodation, including the possibility of cost-sharing.
Key points
From June 1, 2026, the 800+ child benefit and other family benefits for non-EU foreigners will depend on working and paying social security contributions in Poland or being covered by health insurance.
Benefit payments to foreigners will be suspended if there are doubts about their residence in Poland, and the Social Insurance Institution (ZUS) will gain access to Border Guard data on border crossings.
A condition for receiving the 800+ benefit for a foreigner's child will be the child's fulfillment of the Polish compulsory education or schooling obligation.
The legal stay of Ukrainian citizens who arrived after February 24, 2022, is extended until March 4, 2026.
From November 1, 2025, the rules for free collective accommodation for Ukrainian refugees are changing – most people will only be able to use it for 120 days, and a longer stay will only be possible for selected groups (e.g., seniors, people with disabilities) or with a partial fee of 15 PLN per day.
From January 1, 2026, Ukrainian citizens will lose the right to free spa treatment, rehabilitation, dental treatment, drug programs, and other selected health services, except for children under 18.
Non-EU doctors and nurses gain the possibility to extend their license to practice for the duration of their studies at a Polish school, but they must submit an application within 6 months of obtaining the health minister's consent.
A personal appearance at the office is introduced when assigning a PESEL number and registering the address for non-EU foreigners, except for children born in Poland.
