Enhanced Traveler Protection and New Rules for Tour Operators

The Act introduces changes aimed at increasing financial security for travelers by streamlining the guarantee system for tour operators and improving their oversight. Tour operators will be required to maintain more detailed contract lists and inform clients about financial safeguards, while the Assistance Fund will be able to support tourism businesses. The management of Polish Tourist Voucher funds is also changing.
Key points
Tour operators must maintain and update detailed contract lists, increasing transparency and oversight of their operations.
The possibility of combining multiple financial guarantees for tour operators is introduced, with clear rules for travelers to claim compensation in case of issues.
The Assistance Fund can provide partial guarantees to tour operators, making it easier for them to obtain required financial security, which may stabilize the market.
Funds from settlements and refunds regarding the Polish Tourist Voucher will be transferred to the account of the minister responsible for tourism and constitute state budget income.
Serious breaches of obligations, such as evading the duty to maintain contract lists or pay contributions, may result in tour operators being removed from the register and banned from operating for 3 years.
