Changes in minimum wage: higher salaries for employees and stricter penalties for companies
A new law changes how the minimum wage is calculated, meaning a real pay rise for many employees as bonuses and allowances will no longer be included in its base amount. It also introduces higher financial penalties for employers for late payments and other violations, and mandates automatic calculation of interest on delays.
Key points
No more including allowances in the minimum wage: from 2027, functional allowances, other allowances, bonuses, and awards will be paid on top of the minimum wage amount.
Higher penalties for dishonest employers: fines for violating employee rights, such as not paying salaries on time, will double in some cases, up to PLN 60,000 or PLN 90,000.
Automatic interest for late payments: employers will have to calculate and pay interest for delayed wages themselves, without the employee needing to file a request.
Greater protection for contractors: a penalty for complete non-payment of remuneration (not just for underpayment) is introduced, and a payment deadline is set for the 10th of the following month.
Two minimum wage increases per year: if the projected price index is at least 105%, the minimum wage will be changed twice a year – on January 1st and July 1st.
