Temporary Entry Ban for Non-EU Citizens: New Rules and Consequences
The draft law introduces the possibility of a temporary entry ban to Poland for citizens from non-EU countries if their stay poses a threat to security, public order, or health. The Council of Ministers will be able to impose such a ban for up to 12 months, with the possibility of extension. The Border Guard will gain new powers to verify and immediately expel individuals who do not meet entry conditions, and violating the ban carries a high fine and a re-entry ban.
Key points
The Council of Ministers can introduce a temporary entry ban for non-EU citizens if their presence threatens state security, public order, or public health.
The ban can last up to 12 months, with possible extensions, and does not apply to individuals with Polish residency permits, family members of Polish citizens, diplomats, and UK citizens covered by the Withdrawal Agreement.
The Border Guard will be able to immediately expel individuals who do not meet entry conditions, with an appeal possible to the Head of the Office for Foreigners, though this appeal does not suspend expulsion.
Violating the entry ban carries a fine of up to PLN 100,000 and expulsion from Poland with a re-entry ban for up to 5 years.
The law aims to protect Poland's borders from unauthorized transfers of foreigners by other EU countries, strengthening the Border Guard's position.
