Criminal Record Exchange: New Rules for Non-EU Citizens and Stateless Persons.
This law streamlines the exchange of criminal conviction information between Poland and other countries, especially within the European Union, by implementing EU systems. It introduces a requirement for non-EU citizens and stateless persons involved in criminal proceedings to provide fingerprints, aiming to facilitate their identification and identity verification. These changes are intended to enhance security and the effectiveness of international crime prosecution.
Key points
Mandatory Fingerprints for Non-EU Citizens: Non-EU citizens and stateless persons facing criminal proceedings in Poland will be required to provide fingerprints for police databases for identification purposes.
Faster Access to Criminal Record Information: Polish law enforcement and courts will have quicker and broader access to criminal conviction information from other EU countries, and will also share such data abroad.
Easier Self-Check of Foreign Criminal Records: EU citizens (or residents) can now inquire about their criminal record data from other EU member states through the Polish National Criminal Register.
Expanded Register Data: The National Criminal Register will include more detailed information, such as citizenship (or lack thereof/unknown status) and details on terrorist offenses.
