Tax control of cryptocurrencies and real estate: new obligations for users and platforms

The act introduces the automatic exchange of tax information regarding crypto-asset users and real estate transactions between Poland and other countries. Crypto platform users will have to confirm their tax residency or face account suspension, and their financial data will be shared with tax authorities.
Key points
Crypto account suspension: If you fail to submit a tax residency declaration upon request from a crypto exchange or wallet provider, your account and transactions will be blocked after 60 days.
Criminal liability: Tax residency declarations are submitted under penalty of perjury.
Transaction reporting: Crypto exchanges and service providers will automatically report data on your transactions (purchases, sales, and transfers of crypto-assets) to the tax office.
Real estate sales monitoring: Tax offices within the EU will automatically exchange information on real estate sales by foreign residents.
More data in tax ruling applications: Individuals requesting individual tax rulings regarding tax residency or transactions exceeding €1.5 million must provide full identification details.
