Stronger Worker Protection: PIP to Easily Convert Civil Contracts to Employment.
The act significantly strengthens the role of the State Labour Inspectorate (PIP), granting it new powers to quickly convert civil law contracts into employment contracts, ensuring full worker rights. Penalties for dishonest employers will increase, and courts will expedite employment-related cases, offering protection during disputes. The goal is to more effectively combat precarious employment and ensure employment stability.
Key points
The State Labour Inspectorate (PIP) has gained the power to issue administrative decisions that can convert a civil law contract into an employment contract, ensuring full worker rights.
PIP will be able to represent citizens in court, filing lawsuits to establish the existence or content of an employment relationship, making it easier to assert rights.
Financial penalties for employers violating labor laws, including improper employment practices, will be significantly increased (up to PLN 60,000, and in some cases up to PLN 90,000).
Courts will expedite employment-related cases and can protect employees from dismissal or adverse changes to working conditions during a dispute.
Employers who voluntarily convert civil law contracts into employment contracts within 12 months will avoid penalties.
Cooperation between PIP, ZUS (Social Insurance Institution), and KAS (National Revenue Administration) will be strengthened to more effectively detect employment irregularities.
