New workers' rights: fighting bogus contracts and remote labor inspections

The law strengthens protection for workers employed under civil contracts that are actually employment relationships. The Labor Inspectorate gains new tools to combat sham contracts, including the power to issue decisions recognizing such contracts as employment agreements. Workers also gain faster court proceedings and protection from dismissal during proceedings.

The Labor Inspectorate can now issue a decision recognizing a civil contract as an employment contract if working conditions indicate so – without lengthy court proceedings.
Workers whose contracts are recognized as employment gain protection from termination or dismissal from the day the inspection begins.
Labor inspections can be conducted remotely online, streamlining the Inspectorate's operations.
Employers can ask the Inspectorate for an individual interpretation for PLN 40 on whether a contract constitutes employment – but the decision doesn't exempt from liability if facts differ.
Fines for employers violating labor law double – from PLN 2,000 to 60,000, and up to PLN 90,000 for repeat offenses.
The Labor Inspectorate, Social Insurance Institution and Tax Administration will exchange data to more effectively detect illegal employment and tax-insurance fraud.
Employers who voluntarily convert sham contracts to employment contracts within 12 months of the law taking effect will avoid penalties.
