New short-term rental rules: registration, consents, and local limits

This draft law introduces new rules for individuals renting out apartments for short periods, for example, to tourists. Citizens engaging in such rentals will need to register their activity with the municipality and may require consent from their housing community or cooperative. Municipalities will gain tools to regulate and control short-term rentals, aiming to improve order and safety in residential buildings.
Key points
Mandatory registration: Anyone renting an apartment for a short period (up to 30 days) will have to register this activity with the municipal office and pay a fee of up to 100 PLN.
Community/cooperative consent: If you rent out a property that is not your permanent residence, you will need consent from the housing community or cooperative. They can refuse consent due to disturbances to order or safety.
Local restrictions: Municipal councils will be able to introduce their own rules, such as bans on short-term rentals in certain parts of the municipality, limits on rental days per year, or additional safety requirements.
Higher fees: Housing communities and cooperatives will be able to increase operating fees for short-term rental properties if they generate higher costs.
Financial penalties: Operating a rental without registration, exceeding limits, or failing to comply with other regulations carries a fine of up to 50,000 PLN.
Transition period: Individuals already operating short-term rentals have 12 months from the law's effective date to comply with the new regulations.
