New rules for the cryptocurrency market: greater security and investor protection

The act introduces clear rules for the cryptocurrency market in Poland, aligning national laws with the EU MiCA regulation. The changes aim to better protect your money, combat fraud, and make it easier for honest businesses to operate.
Key points
Protection of your funds: Clients' money and cryptocurrencies held on exchanges will be safe and cannot be seized if the platform faces financial trouble or bankruptcy.
No PCC tax: The sale and exchange of cryptocurrencies are officially exempt from the tax on civil law transactions (PCC).
Blocking fraudulent websites: A public register of illegal crypto-related websites will be created, and internet providers will have to block access to them quickly.
Combating fraud and manipulation: The Polish Financial Supervision Authority (KNF) will have the power to quickly block suspicious accounts and halt transactions for up to 96 hours.
Liability for false offers: Creators of new cryptocurrencies will be legally liable for providing false or misleading information in their offering documents (whitepapers).
New Crypto-Asset Council: A special Council, including industry representatives, will be established to review appeals against KNF decisions, preventing regulatory overreach.
Severe penalties for scammers: Operating without a license or engaging in market manipulation will carry heavy fines and up to 5 years in prison.
