New rules for accessing ID card documents

The bill expands the circle of people and institutions that can access documentation related to ID cards, including data of deceased persons. The new regulations will facilitate historical and genealogical research and allow relatives of the deceased to access these documents without having to demonstrate a legal interest. Clear rules on fees are also introduced – if an application is rejected, the fee paid will be refunded.
Key points
Expanded access to documentation: organizations involved in history and genealogy, as well as close relatives of the deceased (spouse, children, siblings) for 10 years after death, will gain the right to view ID card documents.
Access for anyone with a factual interest: people wishing to honor the memory of a deceased person (e.g., distant relatives) will be able to access documents even without a court case – simply showing a factual interest will suffice.
Refund of fees for rejected applications: if the office refuses to release documents, the fee paid will be refunded upon request. Previously, there were no clear rules on this.
New entities entitled to free access: the Constitutional Tribunal and the State Tribunal, as well as institutions performing public tasks, will be able to obtain documentation free of charge.
