New Authorities and Penalties for Political Advertising

This act designates Polish authorities responsible for supervising political advertising online and in the media. It introduces high financial penalties for companies and sponsors who fail to comply with EU transparency rules. It gives citizens the right to report violations and ensures the transparency of information about ongoing proceedings.
Key points
The National Electoral Commission (PKW) will be the main body supervising political advertising, especially during election and referendum campaigns.
Violations can result in fines of up to 6% of a company's annual revenue, imposed by the PKW, with the right to appeal to a court.
Any citizen or entrepreneur can submit a request to initiate proceedings if they notice suspicious political advertising.
Supervision of different market areas is divided among UKE, KRRiT, UOKiK, and UODO, depending on the type of entity broadcasting the ad.
The act implements an EU regulation that has been in force since October 2025, ensuring its effective enforcement in Poland.
