Changes in Motor and Farmer's Liability Insurance: Higher Coverage and Protection in Case of Insurer Insolvency

New regulations increase minimum compensation amounts for motor and farmer's liability insurance. They also introduce mechanisms to protect victims in case of an insurance company's bankruptcy, both in Poland and abroad.

Minimum guaranteed sums in motor and farmer's liability insurance significantly increase (to almost PLN 30 million for personal injury and over PLN 6 million for property damage per event).
The Polish Motor Insurers' Bureau and the Polish Insurance Guarantee Fund will pay compensation to victims in Poland if the foreign insurer of the at-fault vehicle goes bankrupt.
Victims in Poland of accidents caused by vehicles insured abroad with a bankrupt company can file claims with the Polish Motor Insurers' Bureau.
Victims in Poland of accidents caused by vehicles insured in Poland with a bankrupt company can file claims with the Polish Insurance Guarantee Fund.
Discrimination based on nationality or previous place of residence/seat of the vehicle owner is prohibited when calculating OC premiums.
Motor sport activities in designated areas may be excluded from mandatory OC if the organizer or participant has other insurance or guarantee.
Insurance companies will contribute to a special fund within the Polish Insurance Guarantee Fund to ensure funds for payouts in case of insurer insolvency.
