Patient Ombudsman's 2023 Report: Assessment of Patient Rights Compliance

This document is the annual report on the observance of patient rights in Poland for 2023. It highlights that the right to healthcare services is the most frequently violated, particularly regarding accessibility (waiting times for specialists) and quality of care. The report details the Ombudsman's activities, including new compensation funds for victims of medical errors and adverse vaccine reactions, and outlines future challenges such as improving psychiatric care for children and adolescents.
Key points
Access to doctors: The right to healthcare services is 'very often violated', mainly due to long waiting times for specialist appointments and problems with registration at clinics.
New out-of-court compensation: From September 2023, patients can apply for a quick benefit from the Medical Events Compensation Fund for health damage suffered in a hospital, without needing to prove fault.
Treatment safety: The Ombudsman collected 947 reports of adverse events, a 32% increase from the previous year, which is intended to help improve safety standards.
Rights in psychiatry: Violations of the dignity and intimacy of psychiatric hospital patients were found, including the use of direct coercion in multi-person rooms without adequate safeguards.
Medical records: Patients still face refusals and unjustified delays in accessing their medical records, which is considered a frequent violation of the law.
