Poland's Energy Sector Opens to Hydrogen: New Regulations and Market
The act introduces hydrogen into the Polish energy system, creating a legal framework for its generation, transmission, distribution, storage, and trading. For consumers and enterprises, this means regulating the rules for connecting to hydrogen networks, the functioning of hydrogen system operators, and the possibility of choosing a hydrogen supplier.
Key points
Hydrogen is regulated in the Energy Law alongside gaseous fuels and electricity, with definitions for low-emission and renewable hydrogen.
Legal frameworks have been introduced for the operation of hydrogen transmission and distribution networks, along with an obligation for operators to plan their development.
Hydrogen consumers gain the right to purchase hydrogen from a supplier of their choice and to change suppliers.
The Construction Law has been amended to include hydrogen networks and installations in construction qualifications and to exempt certain hydrogen installations from the building permit requirement (e.g., hydrogen generation installations up to 10 MW).
A fee of PLN 300 per 1 kg of hydrogen has been introduced for illegal hydrogen offtake, or compensation may be pursued under general principles.
The President of the Energy Regulatory Office will receive additional funds to implement tasks resulting from the act (the expenditure limit for 2025 is PLN 1,350,000).
