New Supplementary Maternity Leave for Parents of Hospitalized Children
The act introduces a new type of leave – supplementary maternity leave – for parents of children born prematurely, with low birth weight, or requiring extended hospital stays after birth. This will give parents more time to care for their child, while retaining the right to benefits and employment protection. The changes apply to employees, farmers, and uniformed services officers.
Key points
Supplementary maternity leave is introduced for mothers and fathers caring for children born prematurely, with low birth weight, or requiring long hospitalization after birth.
The length of the additional leave will depend on the week of pregnancy the child was born, its weight, and the duration of hospital stay, with the possibility of extending it by one week for each week of hospitalization.
During this leave, parents will receive full maternity benefits or remuneration, will be protected from dismissal, and are guaranteed to return to their previous or an equivalent position.
The new rules cover a wide range of individuals, including employees, farmers, teachers, uniformed services officers, and professional soldiers.
Employers will be exempt from paying contributions to the Labor Fund for employees returning from this leave for 36 months.
Individuals who are already on maternity leave or receiving benefits on the effective date of the act may apply for this additional leave.
