Changes to foreigner protection law: application restrictions at the border

New regulations allow for temporary suspension of accepting international protection applications at the border during destabilizing actions by a neighboring state. New reasons for refusing protection, such as posing a threat to state security, have also been defined.
Key points
A definition of "instrumentalization" is introduced - actions by a neighboring state facilitating illegal border crossing, potentially destabilizing Poland.
Temporary suspension (up to 60 days, extendable) of accepting protection applications at the border is possible in case of instrumentalization posing a serious threat.
The suspension does not apply to persons in particular need of help, e.g., unaccompanied minors, pregnant women, the elderly or ill, unless they used violence when crossing the border.
New grounds for refusing protection have been added: posing a threat to state security or society after conviction for a serious crime.
During the suspension period, the standard procedure for lodging an application at the border does not apply.
