Suspension of MP and Senator Rights During Imprisonment
New regulations state that Members of Parliament and Senators who are deprived of liberty (e.g., arrested or convicted) lose most of their rights and duties related to their mandate during that period. This also applies if they are in hiding or abroad to avoid punishment. However, if they are acquitted or the proceedings are dismissed (with exceptions for conditional dismissal, amnesty, or statute of limitations), they will receive their back pay and parliamentary allowance.
Key points
An MP or Senator deprived of liberty (arrested, convicted) cannot exercise most of their parliamentary rights and duties.
The suspension of rights also applies to those who are in hiding or abroad to avoid punishment.
In case of acquittal or dismissal of proceedings (with certain exceptions), the MP or Senator will receive their outstanding remuneration.
The new rules also apply to cases that began before this law came into force.
