New Rules for Employing Foreigners in Poland: Digitalization and New Obligations

The act introduces comprehensive and uniform rules for hiring employees from abroad. A key change is the digitalization of the entire process – work permit applications will be submitted exclusively online, which is intended to speed up procedures. At the same time, the law imposes new obligations on employers, such as providing a contract in a language understandable to the foreigner, and sets higher penalties for illegal employment.

All applications for work permits and other documents will be submitted exclusively online via a special system.
Employers are required to provide the foreign employee with an employment contract in a language they understand.
The simplified employment procedure (based on a declaration) for citizens of selected countries is extended to 24 months.
The government gains the ability to introduce annual limits on the number of work permits issued to protect the domestic market.
Financial penalties for illegally employing a foreigner are increased, ranging from PLN 3,000 to PLN 50,000.
Applications from companies of strategic importance to the Polish economy will be processed with priority.
Funding from the Labour Fund is allocated for professional activation programs and Polish language courses for foreigners.
Employers must keep a copy of the foreigner's residence document for the entire period of employment.
