Facilitations for highly qualified non-EU workers and their families
The act introduces changes to regulations concerning foreigners, mainly regarding the employment of highly qualified workers from outside the European Union. It facilitates their entry and stay in Poland and other EU countries, and simplifies procedures for their families. Key aspects include recognizing professional experience as qualifications and new mobility rules within the Union.
Key points
New rules for highly qualified non-EU workers: A new temporary residence permit has been introduced for EU Blue Card holders from other EU countries, facilitating their work in Poland (so-called long-term mobility).
Recognition of professional experience: High professional qualifications can now be proven not only by a diploma but also by relevant professional experience (3 or 5 years, depending on the profession).
Easier family reunification: Family members of highly qualified non-EU workers can more easily obtain a residence permit in Poland, especially if the family was established in another EU country.
Greater flexibility in changing jobs: The minimum required employment contract period for the EU Blue Card has been shortened to 6 months. In case of job loss, the foreigner has more time (up to 3 or 6 months) to find new employment without the risk of losing the permit.
Facilitations in obtaining EU long-term resident status: Periods of stay in other EU countries based on an EU Blue Card, student visa, or research visa are now counted towards the required period of stay in Poland to obtain EU long-term resident status.
