Deepfakes Accountability Act: Combating Digital Disinformation and Protecting Citizens
This act aims to combat the spread of fake video and audio recordings, known as "deepfakes." It mandates clear labeling of such content so citizens know what they are seeing or hearing has been altered. This protects against fraud, reputational harm, and election interference, while giving victims avenues for recourse.
Key points
Mandatory Deepfake Labeling: Digitally altered video and audio recordings must include visible watermarks or disclosures indicating their modification. This helps distinguish real content from fake.
Penalties for Violations: Individuals who create or distribute unlabeled deepfakes with intent to defraud, humiliate, incite violence, or influence elections can face fines or imprisonment, as well as significant civil penalties.
Right to Sue: Individuals whose image or voice is used in a deepfake without consent can sue the creators for damages. The act also includes provisions to protect victims' privacy during legal proceedings.
Victim Support and Detection: The act establishes coordinators in U.S. Attorney's Offices to assist victims of deepfakes, particularly those of an intimate nature or created by foreign entities. A task force will also be created to develop deepfake detection technologies.
