Supporting Working Mothers: Breastfeeding Accommodations at Work

New rules give working mothers the right to take breaks to express breast milk at work for one year after childbirth. Employers must provide a suitable, private space, not a bathroom. Small businesses (under 50 employees) may be exempt if it causes undue hardship.
Key points
Working mothers are entitled to reasonable break times to express breast milk for one year after birth.
Employers must provide a private, non-bathroom space for expressing milk, shielded from view and intrusion.
Break time for expressing milk is generally unpaid, unless the employee is actively working during that time.
Businesses with fewer than 50 employees may be exempt if compliance causes significant difficulty or expense.
The law does not override state or local laws that offer greater protections.
