Wage Theft Prevention and Recovery Act of 2022
This act aims to better protect employees from unfair wage practices. It introduces new rules for disclosing employment terms, providing regular pay stubs, and ensuring timely final payments after employment ends. It also increases penalties for employers who violate these rules and makes it easier for employees to recover stolen wages.
Key points
Employers must provide employees with detailed information about their pay and employment classification at the start of employment and whenever changes occur.
Employees will receive regular pay stubs with comprehensive details on earnings, hours worked, and deductions.
Upon termination of employment, employers must make all final payments within 14 days, or face additional penalties.
The act increases financial penalties for employers violating wage laws and makes it easier for employees to claim damages, including interest and triple damages in some cases.
The statute of limitations for wage claims is extended from 2 to 4 years, and from 3 to 5 years for willful violations.
A grant program is established to support organizations assisting employees and employers with wage law compliance and wage recovery.
