Enhanced Student Loan Protection: Data Access and Oversight

This act aims to strengthen protections for student loan borrowers by ensuring the Consumer Financial Protection Bureau (CFPB) receives access to data from the Department of Education upon request. This will enable the CFPB to better monitor the market, and the act also mandates ensuring sufficient staffing to carry out these duties.
Key points
The Department of Education will be required to provide student loan data to the Consumer Financial Protection Bureau (CFPB) as requested by the Director or Ombudsman.
The Secretary is prohibited from entering agreements with loan servicers unless they agree to provide information to the CFPB.
The CFPB Director must ensure that supervisory and enforcement units are provided with sufficient staff to carry out their functions.
Existing Memoranda of Understanding (MOUs) between the CFPB and the Department of Education regarding information sharing must remain in effect and can only be amended to improve coordination.
