Additional Leave for Bone Marrow or Blood Stem Cell Donation

This bill amends the Family and Medical Leave Act of 1993 to entitle employees to additional leave for bone marrow or blood stem cell donation. The leave covers pre-donation, donation, and post-donation activities. Employees may elect to substitute accrued paid leave for this time, though employers are not required to provide paid leave if they would not normally do so in such situations.
Key points
Employees are entitled to a total of 40 hours of additional leave within a 12-month period for bone marrow or blood stem cell donation activities.
This leave is in addition to leave provided under other paragraphs of the Act and covers pre-donation, donation, and post-donation activities.
Employees may elect to substitute accrued paid vacation, personal, or sick leave for this leave, but employers cannot require it.
Employees must provide at least 30 days' notice if foreseeable, and employers may require certification from the relevant transplantation program.
