Mandatory Recall of Vapes Without Prior Government Approval
New regulations mandate the immediate recall of all electronic nicotine delivery systems (ENDS) that have not undergone prior government review before being placed on the market. This means many currently available vape products may be removed from shelves, and manufacturers will need to obtain specific authorizations to sell them again. The aim is to enhance the safety of electronically delivered nicotine products.
Key points
All vape products that have not received premarket authorization must be recalled from the market within 60 days of the act's enactment.
Electronic nicotine delivery systems (ENDS) are now officially included in the definition of tobacco products, subjecting them to stricter regulations.
Manufacturers, importers, distributors, and retailers are required to immediately cease distribution and recall affected products.
Simplified premarket review exemptions based on substantial equivalence to existing products will no longer apply to ENDS.
