Justice for All Act: Strengthening Anti-Discrimination Rights and Access to Courts

This act aims to make it easier for citizens to pursue legal claims in cases of discrimination, including those resulting from seemingly neutral actions that disproportionately affect certain groups. It also introduces new definitions of discrimination, including based on sex, sexual orientation, gender identity, and hair characteristics, and limits the use of arbitration agreements in civil rights disputes.
Key points
Facilitates legal action in discrimination cases, including those where practices have an unintended but negative impact on specific groups (disparate impact).
Expands the definition of sex discrimination to include sexual orientation, gender identity, sex stereotypes, and characteristics related to pregnancy and intersex traits.
Includes discrimination based on natural hair texture and protective hairstyles (e.g., braids, locs) within the definition of racial discrimination.
Prohibits pre-dispute arbitration agreements that force employment, consumer, or civil rights disputes out of court.
Strengthens employer liability for discriminatory acts by employees, removing certain previous legal defenses.
Allows for recovery of damages (including punitive) and legal fees in discrimination cases, whether intentional or based on disparate impact.
Introduces a ban on profiling by law enforcement based on race, ethnicity, national origin, religion, sex, gender identity, or sexual orientation.
