Prohibiting Disclosure of AI-Generated Intimate Digital Depictions Without Consent
This act prohibits the disclosure of intimate digital depictions of individuals created or altered using artificial intelligence without their consent. Citizens gain the right to seek damages in court and protection against such actions, with penalties including imprisonment for violations, aiming to enhance personal safety in the digital realm.
Key points
The new law allows individuals to sue anyone who discloses intimate AI-generated digital depictions without their consent, with potential damages up to $150,000 or actual losses, plus court orders to stop further disclosure.
Disclosing or threatening to disclose such depictions without consent, with intent to harass, harm reputation, or finances, will be a crime punishable by up to 2 years in prison, or up to 10 years if it affects government proceedings or facilitates violence.
Consent to create a depiction does not imply consent to disclose it; disclosure consent must be written, clear, and voluntary, including a general description of the depiction.
The act protects individuals under 18, incompetent, or deceased, allowing their guardians or representatives to assert their rights.
Internet service providers are not liable for good-faith actions taken to restrict access to or availability of intimate digital depictions.
