Easier Amateur Radio Antenna Installation: Ending Restrictive Covenants

New legislation simplifies the installation of amateur radio antennas by preventing homeowners' associations and other entities from imposing unreasonable restrictions. This allows amateur radio operators, who often assist emergency services, to more freely install necessary equipment, enhancing their communication capabilities during crises.

The act permits certain reasonable restrictions, such as compliance with building codes or maintaining the antenna in a safe condition.
Rules for approval processes are introduced: if an application is not decided within 45 days, it is deemed approved.
Certain small antennas (e.g., under 1 meter in diameter, flagpole antennas up to 43 feet, simple wire antennas) do not require prior approval for installation.
In disputes over restrictions, the burden of proof is on the party seeking to impose or maintain the restriction, and penalties are suspended until the matter is resolved.
