Protecting Older Workers: Easier Proof of Discrimination in Employment.

This act makes it easier for older workers, individuals with disabilities, and other protected groups to prove discrimination in the workplace. Instead of demonstrating that age was the sole reason for an adverse decision, it will be sufficient to show it was a motivating factor. This aims to enhance employee protection against unfair treatment.

Easier to prove discrimination: employees no longer need to show that age, disability, race, sex, or religion was the sole reason for an employer's adverse decision.
It is sufficient to demonstrate that age or another protected characteristic was a motivating factor, even if other factors also played a role.
The changes also apply to federal employees and are retroactive to all claims pending or filed after the act's enactment.
