Guaranteed Medigap Access for All Medicare Beneficiaries

This bill amends the Social Security Act to provide for the guaranteed issue of Medigap policies to all Medigap-eligible Medicare beneficiaries, including those under age 65. It also extends these protections to individuals who were enrolled in a Medicare Advantage plan for at least 12 months and subsequently disenrolled to return to the original Medicare fee-for-service program. The legislation mandates full implementation of these changes by no later than January 1, 2030.
Key points
Expands guaranteed issue of Medigap policies to individuals entitled to Medicare Part A and enrolled in Part B, removing the age 65 restriction.
Establishes a one-time enrollment period for individuals who would not otherwise be eligible for guaranteed issue under previous rules.
Guarantees the right to purchase any Medigap policy for beneficiaries who disenroll from a Medicare Advantage plan after at least 12 months.
