Excluding DACA Recipients from Federal Health Insurance Programs and Subsidies

This bill aims to exclude individuals whose lawful presence is solely based on the DACA program (Deferred Action for Childhood Arrivals) from major federal health insurance programs. This means DACA recipients would lose eligibility for health plans on the ACA Exchanges, premium tax credits, cost-sharing reductions, Medicaid, and the Children’s Health Insurance Program (CHIP).
Key points
DACA recipients will be ineligible to enroll in health plans offered through the Affordable Care Act (ACA) Exchanges.
Loss of access to federal subsidies, including advance payments of the premium tax credit and cost-sharing reductions, for health coverage.
Exclusion of DACA recipients from the Medicaid program (low-income medical assistance) and the Children’s Health Insurance Program (CHIP).
Requires the Secretary of Health and Human Services to rescind existing state waivers that currently allow for the funding of health coverage for these individuals.
