Banning QALYs: Protecting Healthcare Access for Elderly and Disabled Patients.

This law prohibits the use of Quality-Adjusted Life Years (QALYs) and similar metrics in all Federal healthcare programs, including Medicare and Medicaid. The goal is to prevent coverage and payment decisions from discriminating against elderly, disabled, or terminally ill individuals based on their perceived life value. These protections will take effect starting January 1, 2025.

Federal health programs, including state-run Medicaid and private Medicare Advantage plans, are banned from using QALYs to determine treatment coverage or reimbursement rates.
It is now illegal to value extending the life of an elderly or disabled person lower than extending the life of a younger, non-disabled person.
The funding structure for the Prevention and Public Health Fund is adjusted for fiscal years 2024 through 2029.
