Student Court Access: Ending Arbitration in College Enrollment Agreements

This act aims to make it easier for students to pursue claims against higher education institutions in court. It removes mandatory arbitration clauses from student enrollment agreements, meaning students will not be forced to resolve disputes outside of court. Additionally, the act prohibits institutions from limiting students' ability to sue them, individually or collectively.
Key points
Students gain the right to sue colleges in court, without being forced into arbitration.
Colleges can no longer require students to waive their right to a court trial, including choice of law, jury trial, or venue.
The changes will take effect one year after the act is passed, allowing time for adjustment.
