Immigrant Detainee Rights: Legal Information and Orientation Programs
This act aims to improve the treatment of individuals detained in immigration matters by providing them with access to legal orientation programs. Non-citizens in custody will have better access to information about their rights and procedures, potentially streamlining immigration processes and reducing costs. These changes are intended to increase efficiency and fairness in immigration proceedings.
Key points
Establishment of an Office of Legal Access Programs to develop and administer legal orientation programs for detained individuals.
Legal orientation programs to be available within 5 days of custody, in English and the five most common native languages spoken by detainees.
Programs will assist in making informed decisions regarding removal and eligibility for relief, and identify vulnerable individuals (e.g., unaccompanied children, those with serious mental disabilities).
The goal is to increase efficiency in immigration proceedings, reduce costs, and improve access to legal services for detained persons.
