This act aims to protect children from drugs that look or taste like candy. It introduces harsher prison sentences for individuals who manufacture or distribute such substances to minors. This is intended to enhance child safety and restrict access to dangerous substances.
Key points
Imposes additional prison terms (up to 10 years for a first offense, up to 20 years for subsequent offenses) for manufacturing or distributing candy- or beverage-flavored controlled substances to individuals under 18.
Applies to Schedule I or II controlled substances that are combined with, marketed as, or flavored/colored to resemble candy or beverage products.
Exemptions include FDA-approved medications and substances altered under a practitioner's medical direction.
Mandates the United States Sentencing Commission to amend sentencing guidelines to include penalty enhancements for these offenses.
