Strengthening Gun Checks: Denying Purchases for Individuals Awaiting Trial.

This law aims to enhance public safety by closing a loophole in the firearm background check system. If a federal or state court orders an individual awaiting trial not to possess firearms as a condition of their release, this prohibition will now be enforced through the national background check system (NICS). This ensures licensed dealers must deny sales to these individuals, directly enforcing pretrial release conditions.
Key points
Individuals released pending trial who are explicitly prohibited from owning or purchasing guns by a court order will be automatically denied during a federal background check.
The national background check system (NICS) is updated to include specific pretrial firearm prohibition orders issued by courts.
$25 million is authorized from 2024 to 2028 to help states and tribes report these restrictions quickly and accurately to the federal system.
