Tribal Sovereignty: Excluding Tribal Enterprises from Federal Labor Law

This bill excludes Indian tribes and their enterprises operating on Indian lands from the jurisdiction of the National Labor Relations Act (NLRA). Consequently, employees working for these tribal entities lose federal protections regarding union formation and collective bargaining rights. The change grants tribes greater autonomy over their internal labor relations, similar to state and local governments.
Key points
Indian tribes and their enterprises on Indian lands will no longer be defined as "employers" under the federal National Labor Relations Act (NLRA).
Employees of these enterprises lose the federal protections for union organizing and collective bargaining guaranteed by the NLRA.
The Act clearly defines "Indian lands," including reservations, trust lands, and specific areas within the State of Oklahoma.
