Stopping Hidden Facility Fees for Telehealth Services.

This law aims to reduce the cost of virtual doctor visits (telehealth) for individuals covered by group health plans by banning extra facility fees during remote consultations. Health plans cannot pay more for a telehealth service furnished by a provider located at a hospital or clinic than if they were located elsewhere. This provides citizens with greater billing transparency and protection against unexpected costs for remote medical services.
Key points
Group health plans cannot pay higher rates for telehealth services solely because the provider is located at a healthcare facility (hospital or clinic).
Healthcare facilities are banned from billing separate facility fees for telehealth services when the provider bills independently for their professional service.
Civil monetary penalties up to $10,000 per violation can be assessed against providers or facilities that violate the facility fee ban.
The changes apply to plan years beginning on or after January 1, 2026.
