Path to Permanent Residency for Temporary Protected Status Holders (SECURE Act)

This Act establishes a new pathway for thousands of foreign nationals who have resided in the U.S. for years under Temporary Protected Status (TPS) or Deferred Enforced Departure (DED) to apply for lawful permanent residency (Green Card). This change offers life and career stability to individuals who fled countries facing repression or emergencies, provided they meet the requirement of at least three years of continuous presence and pass security checks. Furthermore, the law protects applicants from deportation while their applications are pending and grants them immediate work authorization.
Key points
Green Card for Protected Individuals: TPS or DED holders continuously present in the U.S. for at least 3 years can apply for permanent residency, providing long-term legal security.
Protection and Work Authorization: Applicants are protected from removal while their application is pending and automatically receive authorization to work legally.
Family Support: Spouses, domestic partners, and children of the principal applicant are also eligible to apply for permanent residency.
Data Confidentiality: Information provided in the application cannot be used for immigration enforcement purposes, except for cases involving fraud, national security, or serious felonies.
Financial Relief: Application fee waivers (up to $1,140) are available for minors, low-income individuals, or those with serious disabilities.
