Transparency for Government AI Decisions: Right to Appeal Automated Outcomes.

This Act mandates federal agencies to inform citizens when automated systems (AI) are used to make or substantially influence critical decisions affecting their lives, such as access to benefits, employment, or healthcare. Citizens gain the right to clear notice about the use of AI and the opportunity to appeal adverse decisions made by an automated system, including an alternative human review. The goal is to ensure fairness and reliability in government AI use.
Key points
Disclosure Requirement: Agencies must provide plain language notice to individuals when they interact with an automated system or when a critical decision (e.g., regarding benefits, credit, immigration) is made using an augmented critical decision process.
Right to Appeal: Individuals harmed by a critical decision resulting from an automated system have the right to an appeals process and, where appropriate, an alternative review by an agency employee (human review).
Critical Decisions Covered: The law applies to decisions significantly affecting access to education, employment, essential utilities, federal benefits, financial services, healthcare, and housing.
Sunset Clause: The provisions of this Act will cease to have effect 10 years after its enactment date.
