Strengthening Firearm Background Checks: Data Retention and Broader Searches.

This bill aims to improve the accuracy of the National Instant Criminal Background Check System (NICS) used for firearm purchases by mandating searches of specific databases, including the National Data Exchange. The system will retain records related to a potential firearm transfer for as long as necessary to determine the buyer's eligibility. If the system has not made a determination within 30 days, the person will be notified and given a chance to correct their records.
Key points
Expanded Searches: NICS must search databases including the National Data Exchange, the Interstate Identification Index, and NCIC databases to check a person's eligibility to purchase a firearm.
Data Retention: Background check records will be retained for as long as necessary to determine whether the receipt of a firearm by the person would violate the law.
Notice after 30 Days: If the system has not determined eligibility within 30 days, the person must receive written notification and information on how to submit information to correct or supplement their records.
